Terms and Conditions Contract

 

The following terms and conditions apply to the Internet accounts provided by SumterNet, Inc. Livingston, Alabama 35470.

 

GENERAL:

1.        Account sharing is not permitted.  Use of the Internet service supplied by SumterNet, Inc. is expressly limited to the customer, the customer’s immediate family, and/or the customer’s direct employees.

2.        The customer is responsible for all software and equipment necessary for the connection to the Internet.

3.        Use of the Internet for unsolicited advertising is prohibited.

4.        The customer agrees to use the Internet service in a manner consistent with any and all applicable laws.

5.        SumterNet, Inc. may modify these Terms and Conditions upon notice published on-line.  The customer’s use of Internet service after the notice is posted shall constitute customer’s acceptance of such changes to the Terms and Conditions.

6.        The information available on the Internet is the property of its information Providers or other Internet users.  The customers shall not redistribute, reproduce or commercially exploit such information without express written permission of its owner.  Information Providers shall have the right to assert and enforce such copyright provisions directly on their behalf.

7.        Customer submitting information owned by Customer for publication on the Internet grants SumterNet, Inc. non-exclusive permission to distribute the information product worldwide.  Customer retains all right he/she may have to such information.

8.        Customer hereby agrees that any material submitted for publication on the Internet through Customer’s Account(s) does not violate or infringe upon any copyright, trademark, patent statutory, common law or proprietary rights of others, or contain anything obscene, objectionable or libelous.

 

 

LIMITATION OF LIABILITY:

1.        SUMTERNET’S INTERNET SERVICES ARE PROVIDED ON AN “AS IS AS AVAIALBE” BASIS.  NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THOSE OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE ARE MADE WITH RESPECT TO THESE SERVICES OR ANY INFORMATION OR SOFTWARE PROVIDED THEREBY.

2.        Neither SumterNet, Inc. nor its Information Providers are responsible for any damages arising from Customer use of the Internet or inability to access or use Internet services.  There is no guarantee of message delivery.

3.        SumterNet, Inc. is not responsible for Customer’s personal files residing on the Internet.  Customer is responsible for independent backup of all data.

4.        Customer is hereby warned that some sites accessible via SumterNet’s Internet access allow posting, retrieval, and/or electronic mailing of materials that may be considered obscene or objectionable.  SumterNet, Inc. is not responsible for inadvertent or deliberate access to such material and cannot prevent access of such data.

5.        Customer is also warned that some material downloaded from the Internet may contain computer viruses.  Customer should follow industry accepted practices to minimize the possibility of transferring computer viruses including the application of virus detecting and/or correcting software.  SumterNet, Inc. takes precautions to insure that public domain software supplied by SumterNet, Inc. to enable the Customer to access the Internet is free from computer viruses.  However, SumterNet, Inc. cannot guarantee that no computer virus will be present.

6.        SumterNet, Inc. is not responsible for any data or information for websites that are not managed by SumterNet, Inc.

 

 

 

 

 

 

 

BILLING INFORMATION:

1.        The customer agrees to pay SumterNet, Inc. for any charges relating to the customer’s Internet account or accounts, including but not limited to, base quarterly charges and any billed charges for usage hours over the base account hours.

2.        The customer is responsible for all local and/or long distance telephone charges incurred in connecting to SumterNet’s Internet service.

3.        Sales and use taxes, and all other applicable taxes and levies which are applicable to the provision of Internet services shall be borne by the Customer, regardless of whom the taxes and levies are or were imposed upon.

4.        All invoices are due upon receipt.  Quarterly payments by check/cash must be received prior to the beginning of the first day of the next quarter.  Customer shall be held accountable for any usage over the period for which he/she subscribed.

5.        SumterNet, Inc. reserves the right to suspend access for service to a customer’s account for delinquent payments.  A re-connection fee will apply after payment of any delinquent balance.  Customer agrees to pay any and all fees associated with collecting past due charges if account is not paid up to date.

 

 

OPERATION:

1.        SumterNet, Inc. reserves the right to change its services without notice including but not limited to access procedures, hours of operation, menu structures, commands, documentation, and services offered.

2.        SumterNet, Inc. reserves the right to delete Customer’s personal files which have not been accessed for more than one month.

3.        Customer is responsible for confidentiality of all account numbers and passwords.  SumterNet, Inc. will suspend access or change access to customer’s account immediately upon notification by customer that a password has been lost, stolen or otherwise comprised.

4.        Customer understands that Internet services may be interrupted for several reasons, including, but not limited to, malfunctions, maintenance, improvement or as required to protect network resources in the event of malfunctions or misuse.  Customer understands that there may be advance notification of any such interruption of service.  Scheduled outages will be publicized on-line.

5.        SumterNet, Inc. shall not be liable for any delay in or failure to perform the services caused by circumstances entirely beyond its control such as those occasioned by acts of God or other causes or which it could not have reasonably foreseen or any other cause which similarly impedes the providing of service.

6.        SumterNet, Inc. reserves the right in its sole discretion to delete any information entered in Internet computer systems by Customer.  SumterNet, Inc. and its authorized representatives shall have the right, but shall not be obligated, to edit publicly viewable information.

7.        SumterNet, Inc. at its sole judgement, may immediately suspend Customer’s access to the service upon any breach of any of the Terms and Conditions by Customer, including, but not limited to, refusal or failure to pay for services provided or disruptive on-line behavior.

8.        SumterNet, Inc. reserves the right to terminate access to service for any Customer Account which has not been active for six months or longer.

9.        SumterNet, Inc. reserves the right to limit access to service for any Customer Account to a maximum continuous on line time of 3 hours.  You must log off for 30 minutes.  You may reconnect after the 30-minute wait period.

10.     SumterNet, Inc. agrees to provide 325 access hours per month pursuant to the above mentioned rules and regulations.

11.     Any user who goes over 325 access hours in a month will be locked out by the master switch, and in order to be reconnected the user will be responsible for any hours in excess of 325 at a rate of $1.00 an hour, and a $10.00 reconnect fee.
